TERMS & CONDITIONS

GENERAL RISK OF PARTICIPATION

DSC training course participants accept by written consent and assume the inherent risks associated with participating in general sailing activities and/or courses. Participation in sailing can be inherently dangerous. Risks include but are not limited to overexertion, equipment failure, dehydration, serious accidents, weather conditions, water quality and threat from marine life, which may result in injury and/or property damage.

FIRST AID

Permission is given for the Darwin Sailing Club staff to administer First Aid if required. Permission is given to secure medical attention in case of illness/accident whilst on this activity and the participant accepts responsibility for any costs involved including ambulance transport if applicable.

BOX JELLY FISH

During the months of October to May (Wet Season) protective clothing is compulsory and must be worn at all times whilst participating in any water-based activities. During the months of June to September (Dry Season) it is highly recommended that protective clothing is still worn, therefore we will enforce the compulsory wearing of protective clothing during all programs.

FITNESS TO PARTICIPATE

Participants are required to be medically and physically fit and able to participate in registered programs. Participants must not be a danger to themselves or jeopardise the safety and health of others.

PHOTOGRAPHY

Photographs and video recordings may be taken throughout the duration of sailing activities and courses. Participants and/or Parents/Guardian acknowledge that The Darwin Sailing Club has the right to use any media images obtained throughout this course/activity for promotional purposes including but not limited to social media pages and our website.

If you do not consent to this, you will need to notify us in writing by sending an email to sailing@dwnsail.com.au before the commencement date of you course.

REFUND POLICY

If an individual cancels their participation in the course, then the refund policy is set below:

1. Notice period of Cancellation:

a. Less than 14 days prior to the Course/Event - NO REFUND

b. More than 14 and less than 20 days prior to the Course/Event - 50% REFUND EXCLUDING TRANSACTION FEES

c. More than 20 days prior to the Course/Event - FULL REFUND EXCLUDING TRANSACTION FEES

In every circumstance where a refund is requested, the first option is to transfer the participant to another applicable Course/Event if we have a suitable replacement to take your space in the original course. If your place in the Course/Event can be replaced by another person, you will receive a full refund minus transaction fees.

You will not be refunded for a missed session. If you would like to make up a session, you can book a private lesson at your own cost.

2. Cancellation due to illness, injury, or death:

The refund policy section 1. applies for any illness, injury, or death.

3. Event Cancellation:

We may need to change a Course/Events details or cancel a Course because of circumstances beyond our reasonable control, including insufficient enrolments. If a Course is cancelled by us, we will offer you a refund or an alternative enrolment in a different Course, or a later Course offering.

4. Force Majeure:

If a Course/Event is cancelled due a reason outside the control of the organiser, a refund may be provided at the discretion of the Course/Event organiser.

LIABILITY

I will not hold Darwin Sailing Club, its officers, board, contractors and employees responsible for any injury, death, accident, illness, delay, personal loss, personal property damage or other loss sustained by me and herby release Darwin Sailing Club, its officers, board, contractors and employees due to any cause whatsoever, including without limitation, negligence on the part of Darwin Sailing Club or it’s contractors/employees. I further agree to indemnify Darwin Sailing Club and its contractors/employees for any and all legal fees or costs which may be incurred in defending any lawsuit or claim I may bring against them.
